1. Acceptance of Terms

By accessing or using HireSA ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Platform. These Terms apply to all visitors, users, employers, candidates, and others who access or use the Platform.

By creating an account, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.

2. Description of Service

HireSA is a job marketplace platform that connects South African remote talent with global employers. Our Platform provides:

  • AI-powered matching between employers and candidates
  • Job posting and application management tools
  • Candidate profile creation and discovery features
  • Messaging and communication capabilities
  • Training resources and career development content

HireSA acts as a facilitator and does not employ or engage candidates on behalf of employers. We are not responsible for the quality, safety, or legality of any jobs posted, the truth or accuracy of candidate profiles, or the ability of employers to hire or candidates to perform work.

3. User Accounts

Registration: To access certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

Account Security: You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

Account Types: The Platform offers two types of accounts: Employer accounts for those seeking to hire talent, and Candidate accounts for those seeking employment opportunities. You may not create multiple accounts or use another user's account without permission.

4. Employer Responsibilities

If you are using the Platform as an employer, you agree to:

  • Post only legitimate job opportunities with accurate descriptions and requirements
  • Comply with all applicable employment laws and regulations in your jurisdiction
  • Not discriminate against candidates based on race, gender, age, religion, disability, or any other protected characteristic
  • Provide fair compensation and working conditions as described in job postings
  • Use candidate information solely for employment-related purposes
  • Respond to applications in a timely and professional manner
  • Not misuse the Platform to solicit candidates for unrelated purposes

5. Candidate Responsibilities

If you are using the Platform as a candidate, you agree to:

  • Provide truthful and accurate information in your profile and applications
  • Maintain professional conduct in all communications with employers
  • Honor commitments made to employers regarding availability and work arrangements
  • Not apply for positions you are not qualified for or do not intend to accept
  • Respect the confidentiality of employer information shared during the hiring process
  • Update your profile to reflect your current skills, experience, and availability

6. Fees and Payments

Free Tier: HireSA offers a free tier that allows employers to post jobs and contact a limited number of candidates per month. Candidates can create profiles and apply to jobs at no cost.

Professional Plan: Employers may upgrade to the Professional plan at $249 per month, which provides unlimited candidate contacts, advanced filtering and search features, priority support, and additional platform capabilities.

Payment Terms: Professional plan subscriptions are billed monthly in advance. All fees are non-refundable except as required by law. We reserve the right to change our pricing with 30 days' notice to existing subscribers.

No Employment Fees: HireSA does not take any percentage of wages, salaries, or payments between employers and candidates. Workers keep 100% of their earnings.

7. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

  • Posting false, misleading, or fraudulent job listings or profiles
  • Engaging in any form of harassment, discrimination, or abusive behavior
  • Using the Platform to collect user information for spam or marketing purposes
  • Attempting to circumvent the Platform to avoid fees or conduct transactions outside the system
  • Posting content that is illegal, obscene, defamatory, or infringes on others' rights
  • Interfering with the proper functioning of the Platform or attempting unauthorized access
  • Using automated systems or bots to access or scrape the Platform
  • Impersonating any person or entity or falsely representing your affiliation with a person or entity

8. Intellectual Property

The Platform and its original content, features, and functionality are owned by HireSA and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

User Content: You retain ownership of any content you submit to the Platform, including your profile information, job postings, and messages. By submitting content, you grant HireSA a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of operating and improving the Platform.

Feedback: Any feedback, comments, or suggestions you provide regarding the Platform may be used by HireSA without any obligation to you.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HIRESA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

HireSA does not guarantee the accuracy, quality, or legality of job postings or candidate profiles. We are not responsible for the conduct of users on or off the Platform, or for any employment relationships formed through the Platform.

IN NO EVENT SHALL HIRESA'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO HIRESA IN THE PAST SIX MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Termination

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

You may terminate your account at any time by contacting us at hello@hiresa.com. Upon termination, your right to use the Platform will immediately cease. If you wish to terminate your account, you may simply discontinue using the Platform.

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Platform.
